PLEASE READ CAREFULLY AND DULY EXECUTED BEFORE BOOKING AN APPOINTMENT.
1) Deposit:
A 50% non-refundable deposit is required to book and secure a date and time for your session. This deposit also serves as a cancellation fee. All remaining balances are due the day before the photography session.
2) Cancellation:
Where a booking is confirmed and there is a cancellation by the client, the deposit may be credited to a future photography session. This is when the client reschedules at least 72 hours prior to the date of the session and re-books at a mutually agreed date and time.
If the client seeks to reschedule within 48 hours of the session, there will be a postponement fee of 30% of the agreed overall cost (the postponement fee does not include the deposit). This fee must be paid to confirm a new booking date based on the photographer’s availability.
If the client cancels on the day of the session, the client is responsible for paying 100% of the total cost of the session.
In addition, the client may be charged for any expenses incurred by the photographer as a result of a cancellation or postponement.
3) Charges and Timing:
The fee charged to the client is the agreed cost between the photographer and the client. The Photographer generally requests a briefing of the concept. Where extra expenses or time are incurred or needed by the Photographer as a result of alterations to the original briefing by the client or otherwise at their request, the photographer will reserve the right to charge the client additional expenses and fees.
The scheduled time must be observed. If the client is delayed for the agreed scheduled time:
• The client will be allowed only the remaining time for the photography session
• If the client seeks additional time after the established photography session, there may be 20-minute time slots given to the client based on the photographer’s availability. Each time slot of 20-minutes requires an additional payment of $1500 per slot.
(For example, if a client books a shoot for 2:00PM- 3:00PM and arrives at 2:30PM, the session will last until 3:00PM. If the client seeks additional time after 3:00PM and the photographer agrees due to availability, then for every 20-minute slot after 3:00PM there will be an additional charge of $1500).
There is a mutual understanding between The Client and The Photographer that punctuality is important and respected by all parties.
If it becomes apparent when the job starts that it is much bigger or a different job to the agreed briefing it will be made clear to the client that the photographer’s fee may increase.
4) Unedited/ Raw Images:
These images are not provided to the client. The client is entitled only to the final edits for whichever package chosen.
5) Additional Cost:
As it relates to props or rentals such as but not limited to “Studio, House, Gardens, Beaches”, the client must pay these costs / fees.
6) Booking:
Once the client has made a booking for a specific time and date and this date/time has been confirmed by the Photographer, any other work will not accept from other clients for those times and dates.
Should there be a cancellation by the photographer caused by unforeseen circumstances, the photography session will be rescheduled at the very earliest, if the rescheduled time is not convenient to both the client and photographer then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Contract.
7) Client confidentiality:
The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him (save as to be reasonably necessary to enable the Photographer to carry out his obligations in relation to the work).
8) Right to Use:
Images are to be used as agreed at the time of booking and at the time of agreeing the fee. The license to use is limited to the use and period of time specified and no other use may be made of the images without the photographers expressed permission.
9) An agreement must be reached with The Photographer before images are used for any other purpose or after the license to use has expired.
10) Manipulation of the images or use of only a portion of image may only take place with the permission of the Photographer.
11) Right to a Credit:
The photographer asserts both his moral right to be identified as the author of his work and the right to a credit (where possible).
12) Copyright And Ownership:
The entire copyright, title, and intellectual property rights of any Images will remain that of the photographer at all times throughout the world.
13) Exclusivity:
The usage/ rights granted are personal to the Client and may not be assigned, nor may any image submitted to the Client be loaned or transferred to third parties.
The Photographer retains the right in all cases to use the Images covered by this agreement at any time and in any part of the world for the purposes of advertising or otherwise promoting his work.
